Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ClassGini's products and services. By using ClassGini you agree to these Terms.

1. Acceptance

By signing up, accessing, or using the ClassGini platform (the “Service”), you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a school or organization, you confirm that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a ClassGini account. Schools may create sub-accounts for staff, parents, and students under the school's authority.

3. Your account

  • Provide accurate registration information and keep it up to date.
  • You are responsible for all activity under your account.
  • Keep your password and authentication tokens confidential. Notify us immediately if you suspect unauthorized access.
  • Use SSO or strong passwords with multi-factor authentication where supported.

4. Subscription, fees & billing

  • Subscription fees, billing cycles, and inclusions are as set out on our Pricing page or in a signed order form.
  • Fees are payable in advance, exclusive of applicable taxes (GST etc.), and are non-refundable except where required by law or our Cancellation & Refund Policy.
  • If payment fails, we may suspend the Service after reasonable notice.
  • Plan upgrades take effect immediately, with pro-rated charges. Downgrades take effect at the next billing cycle.

5. Acceptable use

You agree NOT to:

  • Upload illegal, infringing, harmful, or fraudulent content.
  • Use the Service to send unsolicited bulk messages (spam).
  • Reverse-engineer, decompile, or attempt to extract source code from our software.
  • Interfere with or circumvent security features, rate limits, or access controls.
  • Use the Service to harass, dox, or harm others (especially minors).
  • Resell, sublicense, or white-label ClassGini without a separate written agreement.

We may suspend or terminate accounts that violate these rules. Severe violations (e.g. content harmful to minors) will be reported to law enforcement.

6. Your content

You retain ownership of all data you upload (student records, marks, schedules, files, etc.) — we call this “Your Content.” You grant ClassGini a limited, non-exclusive license to host, process, transmit, and display Your Content solely as needed to provide the Service.

You are responsible for ensuring you have the lawful basis (parental consent, statutory authority, etc.) to upload personal data of students, parents, and staff.

7. Our intellectual property

ClassGini retains all rights to its platform, code, design, trademarks, and documentation. You may use the Service for its intended purpose under the license granted by your subscription, but you may not copy, distribute, or modify our software except as expressly permitted.

8. Third-party services

The Service integrates with third-party providers (payment gateways, SMS/WhatsApp delivery, cloud storage, AI services). Their terms govern your interactions with them — we are not responsible for outages or content originating from third-party services.

9. Availability & support

  • We aim for high availability and publish system status at classgini.com/legal/status.
  • Standard support is via in-product chat and email at support@classgini.com. Premium support tiers may be available on enterprise plans.
  • We may schedule maintenance windows; advance notice will be given for windows that affect normal hours.

10. Cancellation & termination

  • You may cancel your subscription at any time from your account settings or by contacting support.
  • Cancellation takes effect at the end of the current billing period. Refunds, if any, are governed by our Cancellation & Refund Policy.
  • We may terminate or suspend your account for material breach of these Terms.
  • On termination, you have 30 days to export your data before it is queued for deletion — see Data Deletion Policy.

11. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, ClassGini disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of liability

To the maximum extent permitted by law, ClassGini's aggregate liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to liability. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost data, or business interruption.

13. Indemnification

You agree to indemnify and hold ClassGini harmless from any claims, losses, or expenses (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms; (b) Your Content; or (c) your violation of any law or rights of a third party.

14. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified at least 30 days in advance via email to account administrators and a banner in the dashboard. Continued use after the effective date constitutes acceptance of the updated Terms.
